.: Return Policy

NetzGate tests every card & UCSG appliance it produces to ensure products are the best quality.

1. Return Start Date

"Start Date" as used in this policy means (i) the date this product is shipped from NetzGate Technologies., or (ii) in the case of resale by an authorized NetzGate Reseller, the date not more than Thirty (30) days after original shipment of this product by NetzGate Technologies, or (iii) in the case of a pass through return policy made to an End-User made pursuant to an OEM Agreement between NetzGate and another Party, the date not more than Thirty (30) days after original shipment of this product by NetzGate Technologies. to the other Party executing the OEM Agreement.

2. Returns of Non-Defective Hardware

Unless Customer is subject to a stock rotation policy as part of a written agreement with NetzGate, NetzGate only accepts returns of non-defective hardware if the return is made within thirty (30) days following the Start Date. The returns shall be assessed a 15% restocking fee. NetzGate will accept no returns of non-defective merchandise beyond thirty (30) days. All other returns of hardware products may only be made under NetzGate’s Warranty Policy. If you did not purchase your hardware directly from NetzGate please contact the company where you originally purchased your NetzGate hardware to discuss their return policies.

3. Returns of Non-Defective Software

In NetzGate’s discretion and on a case by case basis, software products that have not been activated may be returned within ten (10) days following the Start Date, and may, in NetzGate’s discretion, be subject to a 15% restocking fee. All other returns of software products may only be made under NetzGate’s Warranty Policy. NetzGate will not be obligated to accept returns of any Software that has been activated or otherwise used.

4.LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NETZGATE IS NOT LIABLE UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR ANY LOSS OF USE OF THE PRODUCT, INCONVENIENCE OR INDIRECT DAMAGES OF ANY CHARACTER, WHETHER SPECIAL, INCIDENTAL OR CONSEQUENTIAL (INCLUDING, BUT NOT LIMITED TO, LOSS OF REVENUE OR PROFIT, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, FAILURE OF CONNECTED EQUIPMENT OR PROGRAMS, LOSS OF INFORMATION OR DATA OR LOSS OF GOODWILL) RESULTING FORM THE USE OF THE PRODUCT, RELATING TO WARRANTY SERVICE, OR ARISING OUT OF ANY BREACH OF THIS AGREEMENT, EVEN IF NETZGATE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE SOLE REMEDY FOR A BREACH OF THE FOREGOING LIMITED WARRANTIES IS REPAIR, REPLACEMENT OR REFUND OF THE PURCHASE PRICE OF THE PRODUCT. THE MAXIMUM LIABILITY OF NETZGATE UNDER THIS DEFECTIVE OR NON-CONFORMING PRODUCT AGREEMENT IS LIMITED TO THE PURCHASE PRICE OF THE APPLICABLE PRODUCT AND ANY DAMAGES THAT MAY BE AWARDED IN A WRITTEN CONTRACT BETWEEN NETZGATE AND CUSTOMER. THE FOREGOING EXPRESS WRITTEN WARRANTIES AND REMEDIES ARE EXCLUSIVE AND IN LIEU OF ANY OTHER WARRANTIES OR REMEDIES, EXPRESS, IMPLIED OR STATUTORY.

5. RMA (Return Material Authorization) Process for Defective Merchandise

Customers who wish to return defective merchandise must contact NetzGate Technical Support prior to contacting an authorized NetzGate RMA representative.

After a NetzGate Technical support technician verifies that the product is defective, NetzGate will request your shipping address, phone number, and serial number. NetzGate will then issue the customer an RMA number. A defective item can only be returned if it references a return material authorization ("RMA") issued by a NetzGate Sales representative. To request an RMA number, the customer must fill out and electronically submit the RMA information form available at www.netzgate.com. The RMA number must be included on the outside packaging of the returned merchandise. Customer must include with the returned merchandise a written description of the defect or nonconformance in sufficient detail to allow NetzGate to confirm such determination. Shipping costs incurred in connection with the return of a defective item to NetzGate shall be borne by customer. NetzGate shall pay any shipping costs incurred with the redelivery of a repaired or replaced item. When returning an authorized return, please return only the hardware and/or software authorized. NetzGate will not replace any hardware and/or software for which an authorization has not been issued. NetzGate will ship a product upon receipt of the return product from you.

6. Shipping

Returns are shipped via Blue Dart/DTDC within India, and via FedEx for international orders. If you have any questions, please contact a NetzGate RMA representative.

7. Dispute Resolution/Governing Law/Consent to Jurisdiction

7.1. Dispute Resolution.

Each party agrees to give the other a written description of any problem(s) that may arise and to make a good faith effort to amicably resolve any such problem before commencing any proceeding. Notwithstanding the foregoing, either party may take any action reasonably required to protect such party’s rights.

7.2 Governing Law/Consent to Jurisdiction

The validity, interpretation and enforcement of this Agreement will be governed by and construed in accordance with the laws of the Republic of India without giving effect to the conflicts of laws provisions thereof or the Republic of India Convention on Contracts for the International Sale of Goods. All disputes arising out of or relating to this Agreement will be submitted to the non exclusive jurisdiction of the courts of competent jurisdiction located in Hyderabad, India.
